Texas Rollover Accidents

While the number of rollover car accidents is relatively low at less than 10 percent of all auto accidents, it accounts for an alarmingly high number of fatalities. According to the National Highway Traffic Safety Administration (NHTSA), over 10,000 people were killed in rollover accidents in 2007 in the United States.

Sports utility vehicles (SUVs) in particular have a tendency to be involved in a rollover accident as their center of gravity is higher than other standard motor vehicles. SUVs had the highest rate of involvement in fatal rollover accidents in 2007, accounting for about 34 percent of vehicles involved in those types of accidents. Compared to pickup trucks at 28 percent, or vans at 17 percent, or passenger cars at 17 percent, SUVs are the most susceptible vehicle to this dangerous type of accident.

Many factors can cause a Texas rollover accident. Often, blame can be placed on the negligent behavior of other motorists on the road. Negligent and distracted drivers may be eating, reading, using a handheld device such as a cell phone, falling asleep at the wheel or driving under the influence of alcohol or drugs, which can cause them to swerve or drive off the road, causing their vehicle to roll. If a driver cuts another driver off, causing one to swerve, that can also cause a vehicle to roll. Being struck by another vehicle is another possible way to cause a vehicle to roll. All of these behaviors can be reason to hold a negligent driver legally accountable for a Texas rollover accident.

Hazardous road conditions can also contribute to a Texas rollover crash. If traffic signals weren’t working properly or were out or absent, if there was debris from another accident left in the road, or if roads and embankments weren’t properly designed, a lawsuit can be made against a city or a county based on the faulty or hazardous conditions of the road.

A Texas rollover accident can also occur because of a mechanical failure in a vehicle; including poor stability or suspension system design, a faulty airbag, defective brakes, tire failure, tire defects, and more. If it is determined mechanical failure was the cause of or a factor in a Texas rollover car crash, automakers and their insurance companies can be held liable.

The severity of injuries sustained in a Texas rollover accident is somewhat related to the number of rolls the vehicle makes as well as whether seatbelts were in use by the vehicle’s occupants. According to the NHTSA, approximately three-fourths of occupants killed in rollover accidents weren’t using seatbelts, causing about two-thirds of them to be completely ejected from the vehicle. Various injuries related to a Texas rollover crash include minor to severe trauma to the head, neck, chest and shoulders, internal bleeding, broken or crushed bones, amputation, paralysis, and death.
